This past week light rain created massive chaos along Interstate 5 in California’s Newhall Pass. According to reports, two successive California big-rig accidents involving nine semis were caused by bad weather. The California Highway Patrol stated that the driver of a dump truck was traveling south in a truck bypass lane on I-5 at Highway 14 when he lost control about 2:20 a.m., causing a collision involving four big rigs. Traffic behind the accident began backing up, and a short while later, five big rigs approaching the scene collided.
Although emergency crews were necessary to remove a truck driver who had become trapped inside the dash of his semi, no serious personal injuries were reported. Following the 18-wheeler accident, truck bypass lanes were shut down for most of the day after more than 400 gallons of diesel fuel spilled onto the roadway.
Motor vehicle accidents involving big rigs are some of California’s most dangerous crashes. Because of the sheer magnitude of an 18-wheeler, when an accident happens the risk for serious personal injury or property damage is high. If you or a loved one has been involved in a Folsom truck accident it is critical to seek the advice of an experienced Folsom personal injury lawyer right away.
Injuries that may result from a truck accident are several and include, but are not limited to:
- Traumatic Brain Injuries (TBI)
- Spinal Cord Injuries (SCI)
- Neck Injuries
- Broken Bones
- Whiplash
- Wrongful Death
Here initial reports cite “weather” as the cause of the big rig accident. However, often more than one factor may play a role in causing any type of car or truck crash, so its always a good idea to have a knowledgeable personal injury lawyer review your case and begin an investigation into any additional factors that may have caused or contributed to an incident.
For example, in certain instances a defective truck part – such as tires or breaks – may have contributed to an accident by not performing as expected. In these situations it may be possible to bring a claim based on negligence or product liability.
Sometimes, the design of a roadway makes stopping, turning or otherwise maneuvering more difficult than it should be to allow for safe passage. In these scenarios, it may be possible to bring a suit for negligence against a municipality or other entity based on negligent “roadway design.”
Additionally a trucking company may also be found culpable for an accident where they have acted negligently by pushing drivers too hard – demanding excessive hours and heavy payloads that violate standards.
It is important to determine each factor that may have played a role in an accident to insure you obtain the compensation you deserve.
