What Are the Excuses Used By Insurance Company to Deny Personal Injury Compensation?
Excuses the insurance company will use to deny compensation – all of them. Essentially, you’re not hurt, or aren’t hurt that badly, if you were it wasn’t caused by this incident, and you should have done back to work long before you did.
Jury instruction for Negligence includes proving the following:
- The other person was at fault,
- You sustained damage, and
- Your damage was caused by the negligence.
Insurance companies will deny and contest all three of these areas, whether or not it is reasonable to do so.
What Are the Insurance companies tactics of Denying Personal Injury Compensation?
Anderson Cooper news reporting aired a 30 minute segment on insurance companies tactics and the title was The Three Ds; Delay, Deny and Defend. Initially, they are really nice to you. The adjuster is friendly, tells you she wants to work with you on getting everything straightened out, all she needs right now is a recorded statement. Then they take a statement that will be used against you months down the road. This is all in effort to delay matters. Then, when the time comes for you to get paid back for all your medical bills, wage loss, pain and suffering, they deny your claim. They claim you were speeding, or you should have seen the uncovered manhole, or that your herniated disc was pre-existing and wasn’t caused by this incident. They basically deny your claim and tell you they aren’t responsible. Then they defend, challenging every aspect of your claim.
They have lawyers and a roomful of “expert” witnesses that make millions testifying on behalf of insurance companies. These experts, many of them doctors, make far more money testifying in legal matters that they ever did in clinical practice. You then must bear the burden of proving your case, incurring both the costs of doing so and the time it takes to do so, which literally can take years. In doing this, insurance companies are winning.
Insurance companies are publicly traded. They have stock holders who are looking for profit on their investment. These companies are hugely profitable by NOT paying you what you deserve without a fight. They engage the Three Ds because a large portion of people who have rightful claims will just walk away. They don’t want the fight, they are tired and don’t want to deal with it anymore.
It is a war of attrition and many times, whether or not they are right or can prove their defenses, the insurance company wins simply by delaying, denying and defending.
