The Insurance Company Made a Bad Offer to Compensate My Accident Injury Case, What Can I Do?

Skip Navigation Links

Insurance companies take advantage of people who are in a bad position to negotiate

So the insurance company that you trusted, that was so nice to you when the car accident first happened, that you thought was going to take care of everything, just made you a personal injury compensation offer that you found to be offensive. Of course they did. That’s what they do. They do it because a certain percentage of the people will take it. They will take the personal injury compensation offer because they have to, because they “are not the type to sue”, or because they just don’t want to have to bother with it. In the aggregate, totaled annually, nationwide, these insurance companies save millions by making you low personal injury compensation offers.

Sacramento personal injury attorney People sometimes take the bad personal injury compensation offer because they have to. They have to because the accident totaled their car and they couldn’t get to work, or the personal injuries prevented them from going to work, and they missed out on a paycheck or two, and now their savings have all been depleted and rent is overdue. Or the car payment is due, or the mortgage payment is due, or any one of many bills is due, including the medical bills that are arriving in the mail (that the insurance company did not pay in full). Because a fall injury, or a car crash injury, or a dog attack can result in a domino effect for many, when the time comes to resolve the personal injury case they aren’t in a position to evaluate and negotiate, many are in a position of crises. The insurance company knows this and takes advantage of it.

Why did they take the insurance company personal injury compensation offer? It is because they are “not the type of people who sue”

So many folk I sit down with are so hesitant to sit down with me, a personal injury lawyer, because they are not the “type of people who sue”. They were injured not of their own fault, they have bills and loss of income, the insurance company is making them an offensive offer, and yet they are not the type to sue. That is some seriously good marketing to create that mindset in people. What we are ultimately talking about is insurance. You are not taking anyone’s home away, taking their car from them, preventing their children from going to college, you are making a personal injury insurance claim and if that insurance company dealt with you fairly, there would be no need for you to sit down with a personal injury attorney.

Because they just don’t want to deal with it.

People accept the offer because they just don’t want to have to hassle with the hassle, to have to meet with a personal injury attorney, to answer discovery, to have their deposition taken. These folk have a right to make their own decision and if their decision is to not pursue the correct amount, rather take what is being offered, then that is their own choice. Insurance company wins.

There is no money up front to hire a personal injury attorney. The attorney will front all personal injury litigation costs. You will most likely net more with that attorney than without, and you will not have to deal with the insurance company. Before the insurance company lulls you into a false sense of security you should hire a personal injury attorney, but in the event you don’t, when that company makes you a bad offer, you still have the option to hire one to get what you deserve.
