The Washington Post reports that a family whose daughter was killed by a hit-and-run driver in a drunk driving accident has filed a multi-million dollar lawsuit in Maryland against JMGM Group, which does business as Dogfish Head Alehouse.
Legal commentators note that the suit may be difficult to win in Maryland because it is one of only a few states in the country that does not have "dram shop" laws - laws which hold taverns, bars and restaurants civilly liable for continuing to serve intoxicated patrons.
In California, bars and restaurants that continue to serve alcohol to obviously intoxicated adults and minor may be held liable for harm they cause. This includes property damage and serious personal injury or wrongful death. Often this provides another avenue to seek compensation for those injured due to the recklessness of others.
It's best to contact an experienced California drunk driving accident lawyer to evaluate this option.
In the Maryland case, the man who killed the child had been served 17 bottles and tequila, two "Lemon Drop" shots and a shot of tequila. The plaintiff hopes to use the lawsuit to encourage legislative change.
